Welcome to Atlanta CDL & Driving School (“School,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, services, training programs, courses, products, and communication channels (collectively, the “Services”).
By accessing our website, enrolling in training, purchasing a program, or using our Services, you agree to these Terms. If you do not agree, do not use our Services.
1) Eligibility & Requirements
To enroll in any training program, you must meet the eligibility requirements under Georgia law and/or federal DOT/FMCSA regulations applicable to commercial driving training and licensing.
You are responsible for:
Ensuring you meet age requirements
Obtaining and maintaining a valid Driver’s License
Obtaining a Commercial Learner’s Permit (CLP) if required for training
Completing any required physicals, drug screenings, background checks, or documentation
Confirming your eligibility with the Georgia Department of Driver Services (DDS)
We do not guarantee that you will qualify for a permit, CDL, endorsements, employment, or licensing approval.
2) No Guarantee of CDL License or Employment
Our school provides education and training only.
You acknowledge and agree that:
We do not issue CDL licenses
CDL testing and issuance is controlled by Georgia DDS and/or third-party examiners
Passing the CDL road test or written test is not guaranteed
Job placement, income outcomes, hiring timelines, and employment results are not guaranteed
Your results depend on individual factors including participation, skill development, schedule attendance, and regulatory requirements.
3) Enrollment, Scheduling & Attendance
Enrollment
Enrollment is not final until:
Payment is received (in full or via approved payment plan)
Required documents are submitted
Any prerequisites are satisfied
Scheduling
Training schedules, instructors, vehicles, and program availability may change at our discretion due to:
Weather
Vehicle maintenance
Instructor availability
Safety conditions
DDS scheduling constraints
Attendance
You agree to attend training on time and prepared. Missed sessions may require rescheduling and may incur additional fees.
4) Payments, Deposits & Refund Policy (VERY IMPORTANT)
All payments are for educational/training services, reserved time, and administrative processing.
Deposits
If a deposit is required:
Deposits are non-refundable
Deposits reserve your spot and cover administrative costs
Payment Plans
If you enroll using a payment plan:
You authorize automatic recurring billing (where applicable)
Failure to pay may result in suspension, cancellation, and collection activity
Missed payments may incur late fees
Refund Policy
Unless otherwise required by law:
All sales are final
No refunds once training begins, regardless of attendance
No refunds for missed classes, scheduling conflicts, failure to show, or failure to complete required documentation
Chargebacks & Payment Disputes
You agree not to file chargebacks for legitimate purchases. If you file confirmable fraudulent or improper chargebacks:
You may be removed from training without refund
You may be responsible for dispute fees, legal costs, collections, and administrative penalties
5) Student Conduct, Safety & Dismissal
To protect instructors, vehicles, and students, we maintain strict safety and conduct rules.
You agree:
Not to drive recklessly or disrespect instructions
Not to arrive under the influence of alcohol or drugs
Not to threaten, harass, or disrupt training
Not to damage school property or vehicles
We reserve the right to:
Refuse service
Dismiss a student without refund
Suspend training access
Report behavior to law enforcement if needed
6) Health, Safety & Training Risks
Commercial driver training involves physical activity and operating heavy vehicles. You assume all risks associated with participation.
To the maximum extent permitted by law:
You agree training is voluntary
You accept risks including injury, vehicle incidents, or accidents
You agree to follow instructor safety rules and all posted safety requirements
We reserve the right to restrict participation if we believe it is unsafe.
7) Medical Fitness, Drugs & Alcohol
You agree:
To comply with DOT medical requirements when applicable
Not to attend training while impaired by drugs, alcohol, or illegal substances
To disclose (when required) any conditions that may prevent safe participation
We may require proof of medical fitness or disqualify participation for safety reasons.
8) Use of Vehicles & Property
You agree:
Training vehicles are for authorized instruction only
You will not operate any vehicle without instructor authorization
You are responsible for damages caused by negligence, intentional misconduct, or failure to follow instructions (as allowed by law)
9) Photo/Video Release (Marketing Protection)
You grant Atlanta CDL & Driving School permission to record, photograph, or film you during training, events, and sessions.
You agree we may use your name, voice, likeness, photo/video content for:
Marketing
Advertising
Social media
Website content
Testimonials
If you do not wish to be filmed, you must notify us in writing before training begins. We will make reasonable efforts to accommodate, but cannot guarantee exclusion from all recordings in public or group settings.
10) Intellectual Property (Protects your program)
All materials provided by the School are proprietary and protected by law.
This includes:
Curriculum
Manuals
Videos
Worksheets
PDFs
Training methods
Scripts
Marketing systems
Online content
You agree:
Not to copy, record, share, sell, or distribute any materials
Not to upload materials to the internet or share with competitors
Not to create derivative programs based on our materials
Violation may result in dismissal and legal action.
11) Online Services & Communications
By submitting your information, you consent to receive communications via:
Phone calls
SMS text messages
Email
Direct messages/social media
You may opt out anytime by replying STOP to SMS, or unsubscribing from email.
We are not responsible for:
Carrier delays
Message delivery failures
Third-party platform issues
12) Third-Party Services & Links
We may reference DDS resources, employers, recruiters, third-party testing providers, and outside programs.
We are not responsible for third-party actions, requirements, services, pricing, or outcomes.
13) Limitation of Liability
To the maximum extent permitted by law:
Atlanta CDL & Driving School is not liable for:
DDS decisions or licensing outcomes
Permit/CDL test failures
Lost income or job outcomes
Scheduling delays
Vehicle issues outside our control
Injuries not caused by proven gross negligence
Indirect, incidental, or consequential damages
Our maximum liability is limited to the amount paid to the School for Services.
14) Indemnification
You agree to indemnify and hold harmless Atlanta CDL & Driving School, its owners, staff, contractors, and affiliates from any claims arising from:
Your conduct
Violations of these Terms
Misuse of vehicles/equipment
Failure to follow instructions
Breach of laws or DDS/DOT requirements
15) Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Georgia.
Dispute Resolution
Before filing any legal action, you agree to:
Provide written notice and allow 30 days to resolve the issue
Attempt resolution in good faith
If not resolved, disputes shall be brought in:
State or federal courts located in Fulton, Georgia
You consent to jurisdiction and venue in Georgia.
16) Changes to Services & Terms
We reserve the right to update:
Program offerings
Pricing
Schedules
Policies
These Terms
Updates become effective once posted. Continued use of Services means you accept the updates.
17) Severability
If any part of these Terms is deemed unenforceable, the remaining sections remain in full effect.
